Terms and Conditions

The following booking Terms and Conditions apply to the services described in the Air Journey,
LLC marketing materials, itineraries and all related extensions and reservations and shall apply
to a Participant, Guest and/or Private Aircraft Owner (hereinafter referred to collectively or
individually as “Participant”) and defined as each person, including minors, named either on the
reservation confirmation or on the contract or on a ticket issued by Air Journey, LLC.

Please read the Terms and Conditions carefully, as completion and submission will indicate
compliance, understanding and acceptance of all Terms & Conditions of this document, and shall
form the express terms of the Participant’s Contract with Air Journey, LLC. If anything in these
Terms and Conditions is (or becomes) invalid or unenforceable, it will still be enforced to the
fullest extent permitted by law and Participant shall be bound by all remaining Terms and
Conditions.

Contract and Initial Deposits. The Contract entered into between Air Journey, LLC (hereinafter known
as Air Journey) and Participant is reflected in the paid confirmation invoice sent by Air Journey to
Participant ‘s Travel Advisor or directly to Participant(s). Initial Deposits per person and Airplane
Registration Fee (to be invoiced separately) shall be paid as follows:

Journeys 10 days or less: $2500 deposit, per person + Airplane Registration Fee
Journeys 11-40 days: $5000 deposit, per person + Airplane Registration Fee
Journeys more than 40 days: $10,000 deposit, per person + Airplane Registration Fee

Remaining Balance Due. If Participant’s Journey is less than 40 days, the remaining balance of the
Journey Price, less the Initial Deposit paid, shall be due 90 days prior to Journey Departure Date.

If Participant’s Journey is more than 40 days, the remaining balance of the Journey Price, less the
Initial Deposit paid, shall be due 120 days prior to Journey Departure Date.

Journey Price. The Journey Price is based on a per person, double occupancy rate, quoted in US
Dollars. Single supplements available upon request, subject to all Terms and Conditions.
Basis of Rates: The rates are based on current tariffs and are subject to change due to unforeseen
circumstances. If it is necessary to levy a surcharge based on a unforeseen circumstance,
Air Journey reserves the right to do so and will notify the Participant at the time of final invoicing. Air
Journey is under no obligation to give a breakdown of the Journey Price although all items stated on

Journey Itinerary are included:
– Best available accommodations and all applicable destination taxes (Suite rooms may be available at some
destinations; more information and additional costs will be provided upon request). Hotels listed in the itineraries
may be subject to change, and best efforts will be made to remain in the same category.
– All meals and all beverages as stated in the itinerary, including house wine or beer at lunch and dinner
and non-alcoholic beverages at all scheduled meals
– All group transportation, including airport transfers for each destination arrival and departure
– All planned excursions as stated in the itinerary
– All professional staff services (i.e. local guides, drivers, porters and wait staff) associated with the
Journey Itinerary, including their tips or gratuities.
– Presence of a Journey Director, who will facilitate clearances, Immigration, refueling, and flight planning.

Not included in the Journey Price: commercial airfare, if necessary; optional travel and trip cancellation insurance; passport
and visa fees; Airport departure taxes, Fees associated with the airports and aircraft, Fuel for the aircraft, personal expenses
such as laundry, telephone, internet, and fax fees; all beverages, meals and tips or gratuity not mentioned on Journey
Itinerary; hotel minibar charges; and inoculation and medication costs of any kind. No refund will be made for any
accommodation or service included in the Journey Itinerary that Participant(s) voluntarily do not use.

Commercial Airfare. If necessary, in an attempt to ensure that all participants travel together on the
same flight, we are happy to assist with scheduling group commercial flights.

Photography And Video: We reserve the right to take photographs or videos (The “Photography”)
During the Journey and to use the Photography for promotional purposes. Participants who prefer their
images not be used must notify us in writing before the commencement of the Journey.

Cancellation and Refunds.
Cancellation by the Participant if Journey is less than 40 (forty) days in duration. Cancellation by
the Participant shall be in writing via mail, fax or email and is subject to the following schedule for a
refund of the Journey Deposit, Journey Price and an Airplane Registration Fee Airplane Registration

Cancellation by Air Journey, prior to Date of Departure. Should Air Journey cancel the Journey
after deposits have been received due to fewer than the minimum participants required, the full deposit
shall be refunded less any nonrefundable costs already paid by Air Journey. Should Air Journey cancel
the Journey at any time due to factors beyond its control (including but not limited to war, flood, force of
nature, riot, civil action or act of God), Air Journey shall refund the Participant whatever portion of
monies are reimbursed by ground operators and accommodation suppliers or other vendors.

Journey In Progress. In the event that any Journey in Progress is rendered impossible, illegal, or
inadvisable whether because of weather, season, strikes, war, civil unrest, government interference, or
any other cause whatsoever, Air Journey shall have the right at any time at its sole discretion, to cancel
any Journey or the remainder thereof, or to make alterations of route, accommodation, aircraft and
price details. Any extra expense as a result of a partial cancellation or change in route or
accommodation incurred as a result thereof shall be the responsibility of the Participant. A “Journey in
Progress” is any Journey that has departed from its initial departure location, even if such Journey is
canceled during the initial flight. If the Participants aircraft experiences a mechanical issue during the
Journey, Air Journey will do its best to assist them to resolve the issue. The assistance may required
third party providers. Any assistance provided by Air Journey under these circumstances may be subject
to additional charges of up to 1,000 per day.

Other Circumstances. Air Journey may at its discretion and without cost or liability to itself at any time
cancel or terminate the Participant’s booking for any reason whatsoever, and in particular but without
limiting the generality of the above, in the event of the illness or the illegal or incompatible behavior of
the Participant who shall in such circumstances not be entitled to any refund except as provided for
under Cancellations above.

Cancellation Insurance. The Participant is advised of the ability to purchase cancellation insurance in
the event of a cancellation for any reason. Additionally, it is the Participant’s responsibility for any other
insurance, including but not limited to medical and curtailment insurance as may be necessary and to
obtain such coverage from their own preferred sources at home, prior to confirming their participation or
embarking on the Journey. If the Participant has paid an insurance premium to Air Journey as agent on
behalf of an insurance underwriter, and the Participant cancels his/her Journey, premiums will not be
refunded but Air Journey will do their utmost to expedite payment to the Participant by the insurance
company concerned. Insurance premiums and refunds are subject to the policies of the insurance

Passports & Visas. It is the participant’s sole responsibility to obtain and have available the
appropriate valid travel documents. Failure to obtain visas and/or entry permits does not negate the
terms and conditions. Passports must be valid for six (6) months after the return of Participant’s journey
and should also have sufficient blank visa pages for entry and exit stamps.
All Participants are advised to check with the appropriate government authority to determine necessary
travel documents. A valid passport is required for U.S and Canadian citizens traveling to all
international destinations. Many destinations also require a visa for U.S. and Canadian citizens, contact
the appropriate consulate or embassy office for entry requirements pertaining to their journey.
Participants may be refused international exit or entrance without refund, payment, compensation, or
credit of any kind without proper documentation, and Participant will be subject to any fine or other
costs incurred by Air Journey which result from improper documentation or noncompliance with
applicable regulations.

Waiver, Release and Indemnification. The Participant recognizes certain risks are inherent in the
activity of travel by private aircraft and cannot be eliminated without destroying the unique character of
this activity, including but not limited to: flight over unknown or foreign terrain, inclement weather, hostel
actions by foreign governments, risk in the consumption of foreign foods and liquids, unavailability of
adequate medical care, lack of familiarity with foreign laws and customs, failure of equipment, willful or
negligent actions by other participants, or intentional or unintentional violation of foreign laws resulting
in confinement or imprisonment. Drinking water and food are usually acceptable all over the region and
usually require no special precautions. Malaria is a hazard in some areas. Before leaving your home
country check with regional health authorities to determine what anti-malarial medication is appropriate
to the regions Participants will be visiting
. Participant assumes the risk and full responsibility for the
risks identified above, those known and unknown, inherent or otherwise. Participation in this activity is
purely voluntary.

Participant represents that he/she is physically and mentally capable of participating in the activity and
of safely using the equipment required for this trip. Participant acknowledges that engaging in the
activity of private aircraft travel requires a degree of skill and knowledge different from domestic flight
within the continental United States and has provided evidence of such skill and knowledge.

Air Journey shall bear no liability for the Participant’s failure to provide proof of such skills and
knowledge. Further, Participant acknowledges understanding that each Participant has indemnified Air
Journey relative to the operation, maintenance and safety of such aircraft.

In consideration of the services provided by Air Journey, their officers, agents, employees and
independent contractors, Participant states: I, on behalf of myself, my personal representatives, and my
heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Air
Journey, its employees and agents, from any and all claims, actions or losses for bodily injury, property
damage, wrongful death, loss of services or otherwise which may arise out of my participation in the
Journey, including transportation, the use of any equipment incurred in such activity and transportation.

I specifically understand that I am releasing, discharging and waiving any claims of actions that I may
have presently or in the future for the negligent acts or other conduct by Air Journey, its employees and
agents. Air Journey and any of its employees, officers, directors, or shareholders, nor any other person
acting for, through, or on behalf of it shall not be liable for any loss, damage, injury, sickness or death
arising from any cause whatsoever including but not limited to any errors or omissions contained in its
literature or brochures, from late or non-confirmation of bookings, or from any cause within or not within
its control, or from any negligence of itself or any agent or of any independent contractor with which it
deals, including any third party from or by whom aircraft or motor vehicles are leased or serviced or
from whom accommodation, meals, tours or transportation.

Participant agrees that if Participant has a legal dispute with Air Journey or any of its officers, agents or
independent contractors which cannot be settled through discussions between the parties, Participant
will attempt to settle the dispute through mediation before a mutually acceptable mediator recognized in
the State of Florida as a qualified person for mediation assignments. If Participant cannot agree with Air
Journey on the selection of a mediator, then Participant agrees that a court of competent jurisdiction
may assign a mediator for this purpose. To the extent mediation does not result in a resolution,
Participant agrees to submit the dispute to binding arbitration through the American Arbitration
Association in the State of Florida. If any portion of this agreement is found by a court or other
appropriate authority to be invalid, the remainder of the agreement, nevertheless, will remain in full
force and effect. The exclusive venue of any dispute that may arise out of this agreement or otherwise
between Air Journey and Participant shall be Palm Beach County, State of Florida.

In order for Participant’s reservation to be completed, Participants must indicate acceptance of
the Terms and Conditions by submitting the reservation form and deposit.
